1. DELIVERY

ESTIMATED DELIVERY PEROIDS commence on the date we receive the full amount of the deposit required for the merchandise you have ordered or the date we receive fabric supplied by any source other than the manufacturer of the furniture, whichever is later.

MERCHANDISE HELD FOR DELIVERY we reserve the right to insist upon the delivery of all merchandise within 30 days of the date of sale or the date the merchandise arrives at our warehouse, whichever is later. Storage charges will be imposed if you fail or refuse to accept delivery within 2 weeks.

DELIVERY CHARGES all deliveries are made by the independent carrier selected by us unless otherwise requested. Deliveries outside of our local delivery area are shipped FOB our warehouse or store, freight collect. You must pay for hoisting and any other extraordinary measures necessary to accomplish delivery.

FURNITURE SIZE you are responsible for determining that merchandise will fit through doorways, stairwells, corridors and elevators.

CLAIMS must be made within 5 days after receipt of furniture. No returns will be accepted without proper return authorization.

2. PAYMENT

A deposit equal to ½ of the list price must be received by us before furniture will be ordered from the manufacturer. Balance amounts must be paid in full prior to delivery to you. COD payments and, at our option, deposits and / or balances must be paid in cash or by certified check or money order. Drop shipments must be paid for in full before they will be ordered from the manufacturer.

3. FURNITURE COVERINGS

We cannot guarantee the wearing ability, color fastness or shrinkage of fabrics, vinyl or leathers products, nor do we guarantee protective fabric finishes, because our suppliers do not guarantee them, unless otherwise noted. Fabric colors may vary somewhat due to dye lot differentials and therefore, we do not assume responsibility for shade variations between sample swatches and final products.

4. WOOD

Color and grain variations are natural characteristics of fine furniture woods. Therefore we do not insure the matching of related pieces or of various surfaces of the same item.

5. CANCELLATION

A cancellation fee of 25% of the purchase price will be imposed if you cancel all or any part of a merchandise order. We reserve the right to cancel any order at any time by notifying you in writing and returning any monies received by us from you on account against the canceled order. Cancellation of specially ordered goods will result in a charge of 50% of the purchase price.

6. FLOOR SAMPLE MERCHANDISE

Floor sample merchandise is sold as is. All sales are final. Please inspect merchandise carefully.

7. ERRORS

Errors in pricing and arithmetic are subject to correction.

8. TITLE

We retain title to merchandise until it has been delivered and paid for in full.

The foregoing terms and conditions represent the entire agreement and understanding relating to the subject matter of this agreement, and supersede and cancel any prior agreement relating thereto.
